BK3.30 Invitation to Apply for residence under the General (Active) Investor Category
Immigration Act 1987 s13D and 13E
- People whose Expressions of Interest have been selected from the Pool may be issued with an Invitation to Apply (ITA) for residence under the General (Active) Investor Category if:
- the information provided does not indicate the presence of any health or character issues which may adversely affect their ability to be granted residence under the General (Active) Investor Category; and
- a business immigration specialist considers that the person's claims in regards to:
- points for age, business experience, investment funds; and
- English language ability; and
- settlement funds,
which were the basis for selection from the Pool, are credible.
- A business immigration specialist may seek further evidence, information or submissions from a person whose Expression of Interest has been selected from the Pool, for the purpose of determining their eligibility to be granted residence under the General (Active) Investor Category.
- A business immigration specialist's decision to invite a person to apply for residence under the General (Active) Investor Category (based on information, evidence and submissions provided prior to application) does not guarantee:
- that the points claimed by the applicant will be awarded; or
- a positive assessment in respect of health, character, English language, or any other policy requirements, of any subsequent application for residence.
- The selection of an Expression of Interest from the Pool may not result in an Invitation to Apply for residence under the General (Active) Investor Category.
