R5.70 Residence permits (26/07/1999)

Immigration Act 1987 ss 16 and 17

1. Residence permits are granted to allow either an indefinite stay in New Zealand or an indefinite stay in New Zealand subject to requirements.
2. Residence permits expire when the holders leave New Zealand, and if holders of residence permits wish to return to New Zealand, they require a returning resident's visa (see X2)
3. Residence permits are placed in the applicant's current passport or other travel document or, if the applicant does not possess a valid passport or travel document, in an NZIS certificate of identity.

   Note: An NZIS certificate of identity is not a travel document.

R5.70.1 Residence permits subject to requirements

Immigration Act 1987 s 18A(1)

1. When a principal applicant is granted a residence permit subject to requirements, the residence permits of any accompanying spouse, partner and dependent child will be subject to the requirement that "the principal applicant comply with the requirements of the principal applicant's permit".
2. For applications based on marriage, de facto, parent, sibling, adult child, and dependent child relationships, any applicant who is sponsored or supported by a person whose residence is subject to requirements at the time the sponsorship was undertaken or support given, will be granted a residence permit subject to the requirement that "[name of supporter or sponsor] comply with the requirements of [his or her] permit".
