WG1.1 When New Zealand citizens or residents are considered to be 'available' (20/04/2002)
New Zealand citizens or residents are considered to be ‘available’ if the circumstances described in either (a) or (b) below apply.
- When carrying out a labour market test (see WG3.10) a visa or immigration officer establishes the existence of a New Zealand citizen or resident worker or workers who are willing and capable of doing the work on offer at New Zealand market terms and conditions. The issue of whether those New Zealand citizen or resident workers are prepared to do the work on the terms and conditions proposed by the employer is not relevant.
- The skills required to do the work on offer are such that a New Zealand citizen or resident could be readily trained to do the work.
