A17.1 Children born in New Zealand on or after 1 January 2006
Immigration Act 1987 s 4A
- A child born in New Zealand on or after 1 January 2006 whom the Department of Internal Affairs has determined is not a New Zealand citizen, is deemed, from the time of birth, to initially have the same immigration status as the most favourable immigration status of either of the child’s parents at the time of the child’s birth.
- That status continues until either;
- the child leaves New Zealand; or
- the child is accorded a different status under, or by the operation of, the Immigration Act 1987.
