RA20 Who may apply for a residence permit (26/07/1999)
Immigration Act 1987 ss 13(2), 17, 18(a), 27A(2)
The following people may apply for a residence permit:
- any person who holds a residence visa and who arrives in New Zealand while that visa is current; and
- any person in New Zealand who holds a temporary permit other than:
- holder of a pre-cleared temporary permit while the holder is still in the customs place at which the holder has arrived in New Zealand, or
- The holder of a temporary permit subject to the condition that the holder has no right to apply for another temporary permit or residence permit; and
- any person exempt from having to hold a permit who anticipates ceasing to be exempt while in New Zealand; and
- any person who holds a returning resident's visa and returns to New Zealand while that visa is current (such persons must, upon application, be granted a residence permit); and
- any person who has been granted a Refugee Travel Document by the New Zealand Government in accordance with the 1951 Convention Relating to the Status of Refugees and who returns to New Zealand while that document is current.
