R5.80 Referring residence decisions to the Minister

Immigration Act 1987 ss 14B(2), 17A(2)

No visa or immigration officer may refer an application for a residence visa or permit to the Minister of Immigration for a decision in the first instance unless the Minister gives a special direction to do so (see RA35).

Note: The effect of the Minister becoming personally involved in the decision in the first instance is to deprive the applicant of appeal rights.
