U6.20 Variations to work permits and visitors' permits to allow study (26/07/1999)

Immigration Act 1987 s 27(7)

  1. Holders of work or visitors' permits must apply for a variation of conditions to their current permit if:
    1. they wish to undertake a course of study longer than 3 months; and
    2. it is inappropriate for some other reason to apply for a student permit.
  2. Immigration officers with Schedule 3 delegations and above may grant a variation of conditions current for the length of the course, provided that they sight evidence that the applicant has:
    1. an offer of a place at an educational institution, and
    2. paid the course fees or is exempt from having to pay them.
