C2.15 Legal aid for refugees or refugee status claimants
Legal services Act 1991 ss 19(1)(ja) and (jb), 19(3)
- Refugees or refugee status claimants are eligible for civil legal aid on or after 1 October 1999 in relation to:
- processing any claim for refugee status made on or after 1 April 1999; and
- processing any other matter arising under C3.10(a) and (b) that first arose on or after 1 April 1999; and
- any judicial review proceedings in relation to matters arising under C2.15(a)(i) or (ii); and
- any application for a review by the Inspector-General of Intelligence and Security of a decision of the Director of Security to make a security risk certificate under section 114D of the Immigration Act 1987.
- Refugees or refugee status claimants are eligible for civil legal aid in relation to the matters in C2.15(a) whether they are in New Zealand lawfully or unlawfully.
- Refugees and refugee status claimants who wish to apply for civil legal aid in relation to the matters in C2.15(a) should be advised to contact a lawyer.
