C6.1 Person claiming refugee status may already be detained
A person claiming refugee status may already be detained as a result of:
- being placed into custody under section 128 or section 128B of the Immigration Act 1987 on arrival in New Zealand; or
- being in custody to await removal or deportation from New Zealand; or
- being the subject of a security risk certificate issued under Part IVA of the Immigration Act 1987; or
- being otherwise in custody according to law; or
- being imprisoned in a penal institution.
