E3.30 Changing a temporary visa

1. A temporary visa holder in New Zealand may apply for a visa of another type at any time before the current visa expires.
2. In determining a visa application the Minister or, subject to any special direction, an immigration officer, in his or her discretion:
   1. may grant or refuse to grant a visa; and
   2. regardless of the class and type of visa that was applied for, may grant a visa of any class and type; and
   3. may impose conditions on the visa granted, or vary or waive conditions that would otherwise apply to it.
3. E3.30 (b) applies unless a provision in the Immigration Act 2009 expressly provides otherwise.
4. An application for a visa must be made in the manner prescribed for the class or type of visa sought (see E4.50.1).
