BM3 Applicants who are not ‘fit and proper’ people

  1. Despite BM2, where an application otherwise meets all requirements for approval and there has been an incident of non-compliance with any relevant immigration, employment or taxation law in force, a business immigration specialist may nevertheless approve the application where:
    1. they are satisfied the breach of requirements was of a minor nature; and
    2. evidence is provided that satisfies a business immigration specialist the cause and consequences of the breach have been remedied.
  2. To determine the nature of the non-compliant activity, a business immigration specialist may consult with WorkSafe New Zealand, the Labour Inspectorate, the Accident Compensation Corporation or any other relevant agency.
