I1.20 Conditions and restrictions of interim visas

I1.20.1 Conditions of interim visas

  1. The conditions on each interim visa will depend on the type of temporary visa held by the applicant, and the type of visa applied for.
  2. The following table describes the type of interim visa and the conditions of the interim visa that may be granted, according to the visa held and the visa applied for.

    Notes:
    - Open work conditions are conditions that allow work in any occupation, for any employer, in any location in New Zealand.
    - For the purpose of these instructions, "work (partnership – any)" means any work visa application covered by WF instructions, including partnership, partner of a worker and partner of a student.
    - Where conditions at I1.20.1 (b) (x) and any of the conditions at (xi), (xii), (xviii) or (xix) could also be applied, conditions specified at (x) will be applied to the interim visa.

  3. Open work visas include several types of applications: asylum seeker, working holiday maker, post-study work visa – open, partnership, partner of a worker, partner of a student, victim of family violence, mass arrival and victim of people trafficking.
  4. Open student conditions are conditions that allow study in any programme of study, at any educational institute, in any location in New Zealand.
  5. Travel conditions will not be applied to the interim visa.
  6. Any variation of conditions on the current temporary visa will be applied to the interim visa if the temporary visa applied for is of the same type as the temporary visa held, except where I1.20.1 (g) below applies.
  7. A variation of conditions held on a current temporary visa may not be applied to an interim visa granted with visitor conditions, except where a person holds a current visitor visa that was granted on the basis of guardianship of a student (see V3.100).
  8. Student visa holders (with conditions allowing the holder to work during the academic year – see U13.15) and work visa holders who have applied for an Accredited Employer work visa (AEWV) may be granted an interim visa with work conditions allowing them to take up the job specified in their work visa application (which is connected to an Accredited Employer’s Job Check), including that the holder:
    1. may only work for the specified employer; and
    2. may only work in the specified occupation; and
    3. may only work in the specified location; and
    4. must be paid at or above the specified renumeration level; and
    5. must be employed full time (as defined at WA3.15(d)); and
    6. may not be placed in a triangular employment arrangement with a controlling third party unless the job approved as part of the employer’s Job Check application involves the employee being placed in a triangular employment arrangement.

I1.20.5 Restrictions of interim visas

The holder of an interim visa may not apply for any visa while the interim visa is current.
