H5.20 Making an application for a visa or variation of conditions (12/04/2022)

- A person may only apply for a visa or variation of conditions under these instructions if they are invited to do so.
- An application must be made within 4 months of the date of the invitation to apply.
- Despite (b) above, an application as a new and returning student (H5.30.21(c)(vii)) or a Maanaki Scholarship student (H5.30.21(c)(viii), must be made within 1 month of the date of the invitation to apply.
- An application for a visa must be made in the prescribed manner.
- An application for a variation of conditions must be made by submitting the following to an immigration officer:
- the completed form approved for this purpose; and
- the prescribed fee (if any); and
- the documentation and evidence requested in the invitation to apply, including evidence of the applicant’s critical purpose in New Zealand.
- A person who is invited to apply for a visa or to request a variation of conditions on the basis of having been determined to be a ‘critical health worker’ (H5.30.1) or an ‘other critical worker’ (H5.30.5) may be required to provide a copy of the employment agreement or offer of employment for the role (see W2.10.10).
