WA4.15 Currency and conditions of Accredited Employer work visas (27/11/2023)

  1. An Accredited Employer work visa may be granted for the period for which the employment is offered, up to a maximum of:
    1. five years for employment assessed as being paid at least the median wage (WA3.15(b) (WA3.15 Acceptable employment, https://www.immigration.govt.nz/opsmanual/#77177.htm)) or
    2. the maximum duration a visa may be granted for specified in WA4.10.10 for employment paid below the median wage or
    3. the balance of five years, where the applicant holds an Accredited Employer work visa granted on or before 26 November 2023 and the Job Check number is being re-used as set out at WA4.10.20.
  2. Despite (a)(i) and (ii) above, where the grant of a visa would result in the holder exceeding the maximum continuous stay period allowed under WA4.10.7 or WA4.10.10, the visa must only be granted for the remainder of the maximum continuous stay period.
  3. Despite (a)(ii) above, an Accredited Employer work visa granted on the basis of re-using a Job Check number (WA4.10.20) for a role as part of the Care workforce sector agreement may only be granted for the balance of the 36-month maximum visa duration.
  4. Accredited Employer work visas will be subject to conditions that the holder:
    1. may only work in a specified occupation; and
    2. may only work for a specified employer; and
    3. may only work in a specified location; and
    4. must be paid at or above a specified remuneration level; and
    5. must provide evidence of the payment of remuneration if requested by an immigration officer; and
    6. unless (d) below applies, may not be placed in a triangular employment arrangement with a controlling third party (WA2.60.15).
  5. An Accredited Employer work visa holder may be placed with a controlling third party if the job approved as part of the employer’s Job Check application involved the employee being placed in a triangular employment arrangement.
  6. Despite E7.10(a)(ii) immigration officers must determine applications for an Accredited Employer work visa submitted on or before 26 November 2023 and remain undecided as at 27 November 2023, in accordance with the Temporary Entry Accredited Employer work visa instructions in effect on and after 27 November 2023.
