E7.32 Applications for temporary visas which cannot be approved because of risk that applicant may overstay permit

Immigration Act 1987 ss 14D(4)(b) and (6), 14DA(2)

1. If, after undertaking verification, a visa officer considers that an application for a student visa or visitor's visa cannot be approved under normal temporary entry policy because of an identified risk that the applicant may remain in New Zealand after their permit expires, the officer may consider (if the identified risk is marginal only):
   1. issuing a limited purpose visa instead of the student visa or visitor's visa applied for (see L4); or
   2. imposing a bond as a precondition to issuing a visitor's visa (see E4.58.15).
2. The identified risk is marginal if it is minimal, insubstantial or remote.
3. If the identified risk is more than marginal, the application must be declined (see E7.35).
