S1.41 Residual Pacific Access Category Places Policy (04/04/2005)

1. If the annual quota of places available for each country under the Pacific Access Category is not filled by applicants drawn from the ballots, the NZIS will call for residence applications from applicants who:
   1. are citizens of the countries that have unfilled places; and
   2. are lawfully in New Zealand at the time their application for residence is made; and
   3. have an acceptable offer of employment, or have a partner, included in the application, who has an acceptable offer of employment (see S1.40.30); and
   4. are aged between 18 and 45 inclusive; and
   5. meet a minimum level of English language ability (see S1.40.40); and
   6. meet the minimum income requirement (see S1.40.35) if they have dependants; and
   7. meet health and character requirements.
2. Principal applicants who are citizens of Tonga must have been born in Tonga or born overseas to a Tongan citizen who was born in Tonga.
3. Principal applicants who are citizens of Kiribati must have been born in Kiribati or born overseas to a Kiribati citizen who was born in Kiribati.
4. Principal applicants who are citizens of Tuvalu must have been born in Tuvalu or born overseas to a Tuvaluan citizen who was born in Tuvalu.
5. Principal applicants who are citizens of Fiji must have been born in Fiji or born overseas to a Fijian citizen who was born in Fiji.
6. Partners and dependent children included in applications under the Pacific Access Category must meet health requirements policy (see A4).
7. Partners and dependent children included in applications under the Pacific Access Category must meet character requirements (see A5).
8. Applications will only be accepted if sent to the designated receiving office in New Zealand on the form Application for Residence in New Zealand (NZIS 1000).
9. Applications that are lodged in the prescribed manner (that meet all mandatory lodgement requirements) will be processed in the order in which they are received. If more applications are received than there are places to fill, the additional applications will be accepted and processed first if there are further places to fill in a subsequent period.
