E2.10 Who may apply for a temporary permit

Immigration Act 1987 s 25(1), 35D(1)

The following people may apply for a temporary permit:

  1. any holder of a temporary visa who arrives in New Zealand while that visa is current; and
  2. any person arriving in New Zealand who is exempt from having to apply for and hold a visa to travel to New Zealand; and
  3. any holder of a current temporary permit who is in New Zealand; and
  4. any person listed in section 35D(1) who wishes to be granted a pre-cleared temporary permit; and
  5. any person:
    1. whose residence permit has been revoked, and
    2. who has not appealed against the revocation, and
    3. who applies for a temporary permit before the date on which the revocation of the residence permit becomes effective.
