N1.1 Definition of 'transit passenger'
Immigration Act 1987 ss 2, 129
Transit passengers are persons who:
- arrive in New Zealand from another country while in transit to another overseas destination; and
- throughout the whole period (up to a maximum of 24 hours from the time of arrival) during which they are in New Zealand, remain:
- on board the craft they came to New Zealand on, or
- in a Customs place (ie, in the port or airport secure area), or
- in the custody of the police.
