WG3.5 Determining requests to employ non New Zealand citizen or resident workers (29/04/2002)
- Visa and immigration officers must not give an approval in principle to employ a non New Zealand citizen or resident worker unless they have first conducted a labour market test (see WG3.10) and are satisfied:
- that the employer has to recruit suitable New Zealand workers, and
- that there are no New Zealand citizens or residents available to do the work offered, and
- that the job offer is both genuine and sustainable for the duration of the proposed employment contract, and
- that the employer will comply with the relevant employment and immigration law (see W2.10.5).
