D3.25 Deportation liability if visa held under false identity

A person who is liable for deportation under section 156 of the Immigration Act 2009 may appeal to the Tribunal:
- If the visa was a temporary or interim visa:
- on humanitarian grounds not later than 42 days of first becoming unlawfully in New Zealand; and
- If it was the Minister who determined that the visa was held under a false identity the person has 14 days from the date of service of a deportation liability notice to give good reason why they should not be deported.
- If a residence class visa:
- on humanitarian grounds not later than 42 days after first becoming unlawfully in New Zealand; and
- if it was the Minister who determined that the visa was held under a false identity, the person may, not later than 28 days after the date of service of a deportation liability notice, appeal to the Tribunal on the facts against liability.
