Y3.10 Persons who are or are likely to be a threat or risk to security, public order, the public interest or are members of a terrorist entity. (29/11/2010)

Unless a special direction is given or section 83 of the Immigration Act 2009 applies, a person is not eligible for a visa or entry permission and no visa waiver may apply if the Minister has reason to believe that the person:

  1. is likely to commit an offence in New Zealand that is punishable by imprisonment; or
  2. is, or is likely to be, a threat or risk to security; or
  3. is, or is likely to be, a threat or risk to public order; or
  4. is, or is likely to be, a threat or risk to the public interest; or
  5. is a member of a terrorist entity designated under the Terrorism Suppression Act 2002.
