H8.5 Expression of Interest and Invitation to Apply (15/03/2022)
- An application for a 2022 Special Ukraine Visa is a two-stage process:
- the New Zealand sponsor submits an Expression of Interest where they nominate a family member (or family members) to sponsor (“the Nominated Family Member”); and
- an immigration officer may then invite the Nominated Family Member or Members to apply, as well as any partner or dependent children of the Nominated Family Member.
- A New Zealand sponsor may submit an Expression of Interest by:
- using an approved form provided for this purpose on the Immigration New Zealand website; and
- confirming that the Nominated Family Member or Members agree(s) to the notification of an Expression of Interest made on their behalf.
- The Nominated Family Member is the person who holds the relationship with the New Zealand sponsor as described in H8.20.5.
- An Invitation to Apply will only be issued if the Expression of Interest was submitted on or before 15 March 2023.
- An immigration officer may invite the Nominated Family Member or Members to apply for a 2022 Special Ukraine Visa if they are satisfied that:
- the expression of interest was submitted by the New Zealand sponsor on the Nominated Family Member’s behalf; and
- the New Zealand sponsor appears to meet the requirements outlined at H8.20; and
- the sponsor has declared that the Nominated Family Member was ordinarily resident in Ukraine as at January 2022 (see H8.15); and
- the Nominated Family Member appears to meet family relationship requirements; and
- the information available does not indicate any health or character issues that would prevent the Nominated Family Member from being granted a 2022 Special Ukraine Visa.
- An immigration officer may invite the partner of the Nominated Family Member to apply for a 2022 Special Ukraine Visa if they are satisfied that:
- the partner appears to meet partnership requirements outlined at E4.1.20; and
- the information available does not indicate any health or character issues that would prevent the partner from being granted a 2022 Special Ukraine Visa; and
- the Nominated Family Member has been, or is being, invited to apply for Special Ukraine visa.
- An immigration officer may invite the dependent child of a Nominated Family Member to apply for a 2022 Special Ukraine Visa if they are satisfied that:
- the dependent child appears to meet the definition of a dependent child outlined at R2.1.30; and
- the information available does not indicate any health or character issues that would prevent the dependent child from being granted a 2022 Special Ukraine Visa; and
- the Nominated Family Member has been, or is being, invited to apply for a 2022 Special Ukraine Visa.
