H5.20 Making an application for a visa or variation of conditions (to 29/07/2024)

1. A person may only apply for a visa or variation of conditions under these instructions if they are invited to do so.
2. An application must be made within 4 months of the date of the invitation to apply.
3. Despite (b) above, an application must be made within:
   1. 1 month of the date of the invitation to apply where the applicant is a new and returning student (H5.30.21(c)(vi)) or a Maanaki Scholarship student (H5.30.21(c)(vii); or
   2. 2 months of the date of the invitation to apply for all other applicants where the applicant expressed interest on or after 8 July 2022.
4. An application for a visa must be made in the prescribed manner.

   An application for a variation of conditions must be made by submitting the following to an immigration officer:

   1. the completed form approved for this purpose; and
   2. the prescribed fee (if any); and
   3. the documentation and evidence requested in the invitation to apply, including evidence of the applicant’s critical purpose in New Zealand.
5. A person who is invited to apply for a visa or to request a variation of conditions on the basis of having been determined to be a ‘critical health worker’ (H5.30.1) or an ‘other critical worker’ (H5.30.5) may be required to provide a copy of the employment agreement or offer of employment for the role (see W2.10.10).
