BK4.5 Approval of applications under the General (Active) Investor Category (26/11/2007)
- under the General (Active) Investor Category are assessed against:
- age, health, character and English language requirements; and
- investment and settlement fund requirements; and
- business experience requirements.
- For an application under the General (Active) Investor Category to be approved:
- the principal applicant and family members included in the application must meet health and character, and English language requirements where required; and
- the principal applicant must qualify for the points for business experience and nominated investment funds on the basis of which their Expression of Interest was selected from the Pool; and
- the principal applicant must be aged 54 years or younger; and
- the principal applicant must have a minimum of four years of business experience; and
- the principal applicant must nominate funds and/or assets equivalent in value to at least NZ$3.5 million (including NZ$1 million of settlement funds) and demonstrate ownership of those funds and/or assets); and
- the principal applicant must demonstrate that the nominated funds have been legally earned or acquired; and
- the principal applicant must invest a minimum of NZ$2.5 million for a period of four years in New Zealand; and
- the transfer and placement of nominated investment funds in an must be completed in accordance with the policy in BK8.10.
- Despite BK4.5(b)(ii) above, if a principal applicant does not qualify for the points for business experience and nominated investment funds on the basis of which their Expression of Interest was selected from the Pool (see BK3.20), a business immigration specialist may, on a case by case basis, determine that the application may nevertheless be approved, where the principal applicant has satisfied a business immigration specialist that there was a reasonable basis for making the claim for points in the Expression of Interest and that in making that claim there was no fraud or intent to deceive.
