C4.5 Confidentiality (26/07/1999)

  1. The NZIS including the RSB must keep the identity of refugee claimants strictly confidential at all times.
  2. The provisions of the Official Information Act 1982 and the Privacy Act 1993 apply to information concerning refugee claimants.
  3. However, confidentiality obligations of the RSB are subject to section 7(1) of the Privacy Act, which states that certain provisions in other legislation may authorise or require personal information to be made available.
  4. Certain Government agencies, such as Work and Income New Zealand (WINZ) and Inland Revenue, are entitled to request information under relevant legislation. (For example, section 11 of the Social Security Act 1964 and section 17 of the Tax Administration Act 1994).
