C3.1 What is a detainee? (26/07/1999)

A detainee is a person who:

on arrival in New Zealand has been placed in custody under section 128 or section 128B of the Immigration Act 1987; or
has been placed in custody to await removal from New Zealand; or
has otherwise been placed in custody according to law; or
is imprisoned in a penal institution.
