C3.25 Declining the claim or refusing to accept a further claim (26/07/1999)

  1. If the detainee has a representative, the decision to decline the claim or refuse to accept a further claim and covering letter must be delivered in person:
    1. to the representative or,
    2. if appropriate, to the detainee, in which case a copy of the decision and covering letter should be faxed or delivered by registered post to the representative.
  2. If the detainee has no representative, an NZIS officer must deliver the decision and covering letter in person.
  3. The covering letter accompanying the decision must contain the following 2 paragraphs, either (if there is a representative):
    1. The Refugee Status Appeals Authority will only consider an appeal lodged within 5 working days of the date of receiving this decision.

      The right of appeal to the Refugee Status Appeals Authority does not in itself inhibit removal. Your client is at present in custody and, unless an appeal is lodged, will be removed on the first available flight.

    or (if there is no representative)

    1. Refugee Status Appeals Authority will only consider an appeal lodged within 5 working days of the date of receiving this decision.
